When is a juvenile an adult?
Should 16- and 17-year-olds be tried as adults or as juveniles? It makes a big difference, in charges and penalties. Once in prison, the teenagers have much less chance of turning their lives around. On the other hand, if they commit adult crimes, shouldn't they serve adult sentences?

I agree with "Real American". Do the crime--Do the time! Otherwise, you will see drug dealers and other criminals recruiting and using kids-10-17 years of age as "hit men", robberies and more violent crimes; like they did when the law changed in the 1990s in NY. If we are NOT going to hold the parents accountable--then we MUST ensure that law abiding citizens--especially our elderly.

Whew--harsh.
So I guess it depends on whether one views the justice system as penal, rehabilitative or a mixture of both. If it's the first, what is the best setting to really punish those bad people? If the second, particularly with the plasticity of younger neural passages, how can the prison system be structured in order to maximize personal growth? Unfortuneately the system seems to be the last by default--as a society we haven't clarified the aims of institutionalizing lawbreakers therefore the system does a mediocre job of both.

What has happened to our children? I tell you you can not correct them by spanking that is alot of the problem. There is a big difference in correcting them and abusing them. If you do the crime you should have to pay the price. This day and time most juveniles have to raise themselves. They have no structure at home but they also know right from wrong. If they don't put themselves in the wrong place at the wrong time they can survive. You don't have to commit a crime to be "Cool".

It is obvious that the comments of those supporting kids being locked up as adults have never known anyone personally affected by this law. I live in Georgia and the law is the same. I have personally witnessed this law at work and it was to the detriment of the kids involved, especially those who have not yet been convicted of a crime.
I don't think that most people realize that our justice system makes no provisions for these kids to finish school nor do they make any provisions to protect them from the adult criminals that they are incarcerated with. Yes, I agree, if you do the crime, you must do the time, but is locking kids up in an adult prison the answer, especially when the justice system doesn't do a good job of proving guilt or innocence? Think of your own kids, nieces, nephews, etc. who are within the age range of these laws, how would you feel if they were caught up in this system? Do you think they are ready for adult prison?
Remember, you are "guilty, until proven innocent," by our current justice system, so some kids who have not committed a crime get caught up in this law as well while prosecutors and detectives try to make their case.
I would challenge most of you who are in support of these laws to visit your local jail or prison and see the conditions that these children, yes, children have to endure. Or, better yet, contact a parent of a child that is caught up in the system as a result of this law, and hear the hurt in their voice as they talk about their child who is locked up with adults.
The United States is one of the few countries that locks up its kids. Most other countries have some form of restorative justice that involves rehabilitating kids instead of locking them up and throwing away the key. Kids need to be locked up with kids, and adults with adults.

kids don,t know any better so they should just get grounded for 5 months or a good stiff spanking as punisment and also kids don,t get to vote on the law why should they have to be punished for breaking it.I say free the kids inprison the adults.

are you guys insane ppl are jealus of these kids for bening young did you know they tryed to put a 6 year old in the slammer for not going to sleep in nap time he did not figet or move or even make a noise!but they where jealus because evberyone looks at him with love in there eyes because hes a cute little boy.but with nothing in there eyes for him bcause hes an old man.and they lucly got a judge withg a brain that let him go but he wil always be scared for life for the day he spent in jail.I ask all of you where has the world gone when will this end where will this end.
