A question for the lawyers out there

Can anyone explain to me how this proposal could be constitutional, and how it could be a good idea from a practical standpoint?

I don't agree with it, but if Congress gave the President such authority, I believe it would be constitutional. The powers demanded are delegated to the President and Congress. Federal guarantees of due process and other constitutional rights extend to citizens of the United States. Military law is a different animal altogether.

Perhaps. But it reads like a recipe for a kangaroo court. And if what you're after, in addition to punishing crimes, is information that can be used to prevent future acts of terror -- and I would certainly hope that's what we'd be after -- why would you want that?
