Put Mohammed on trial
Now that Khalid Sheik Mohammed reportedly has confessed during a Combatant Status Review Hearing to a leading role in the 9/11 attacks, he should be put on trial in the federal court system.
Mohammed is notable locally because he earned an engineering degree at A&T in the '80s. Let's hope his stay in Greensboro didn't contribute to his hatred of the United States. He clearly didn't fall in love with this country.
His legal status, like those of other detainees at Guantanamo Bay, has been hazy. Many al-Qaida operatives aren't necessarily prisoners of war, enemy combatants or even criminals unless there's specific evidence that they committed crimes.
In Mohammed's case, there must be a considerable file of evidence. Enough to convict him in a court of law of conspiracy to commit acts of terrorism and mass murder? Let's find out.
I suppose there could be certain problems regarding his arrest and long detention. He has been denied the rights that would have been afforded to an American criminal suspect, like access to an attorney. Maybe he's been tortured. Could a judge dismiss charges against him on technical grounds? For that reason, is it better to try him in a military court? I don't know.
At this point, however, as much openness as possible would be beneficial. Let the world see evidence of al-Qaida's criminal activities. It will be a good reminder of the forces at work against civilized society in the world and what's at stake in the war against terrorism.
Addendum, noon Thursday: A revised transcript released this morning includes Mohammed's statement that he personally beheaded American journalist Daniel Pearl in Pakistan. That has been previously suspected from video of the sadistic crime.

Alledged! Confession? Do you really think we got the number 2 guy back in 2003 and we still can't find the number 0ne guy even to today.

The skinny on the Sheik is that he did not make the step team he was trying out for at A&T and this pissed him off. He reportedly said: "I'll come back and show you country-as#@d, M-f'ers" and the rest is history and thousands of people blown up. Think about it. They should have just let him on the team.

Yeah - mass murder is really funny, YHIHF. Run out of Dot Kearns jokes today?
As for Khalid Sheik Muhammad, he should be put on trial and, if found guilty, punished to the fullest extend of the law. I know the N&R isn't a fan of the death penalty, but I would think even you guys could make an exception in his case.

Make that "extent of the law". I wish you had an "edit post" feature on these blogs.

Don't worry about typos.
I'll admit, if KSM is found guilty just of the Pearl murder, let alone 9/11 involvement, it would be hard to argue he doesn't deserve the death penalty.

Just, it looks like somebody is going a little too long without, how should we say, "animal release". We can all only hope that this would be remedied fairly soon.
Best of Luck

Doug, as the above post appears to be a crude insult directed at me, would you be willing to remove it? Unlike the N&R staff members, I don't feel compelled to suffer verbal abuse from this crowd.

Yeah Just. We sure wouldn't want the general bloggging public to know that a fictional cyber-being by the name of "Just Saying" isn't getting any.

YHIHF, this forum should be used a bit more responsibly. You're not adding anything constructive or clever to the discussion.

Well, it appears that Mohammed is pouring his terrorist heart out big time after some more waterboarding therapy sessions. Let's look at some of the crimes he have fess up to in the last 24 hours by the CIA.
1. He was the dude that commanded 9/11 from top to bottom and even funded it out of his own pocket.
2. He did go to A&T in the 80's and finished in Auto vocational shop 101 and basic skydiving 102.
3. He form the first local chapter of Mohammeds for Jocks at Guildford College as a 527 political group in 1985.
4. He lead the first wave of window washers on the Twin Towers in 1993 as a inspection tour for future operations.
5. He personally founded the Egypt movement for religious animal rights and peace at the Great Pyramid during the 7 day war.
6. He personally kidnapped Jimmy Carter, in 1979 and held him hostage and than release him in the Great October surprise for the Republican Presidental candiate Ronald Reagan.
7. He personally stole the atomic bomb plans from India and secretly tested it in North Korea.
8. He personally founded pay in advance centers near all military bases in the united states and set a interest rate that even the federal reserve system borrows from the Centers.
9.He also is the father of Nicole Smith daughter and was married to her 2 nd husband in Texas before he passed away in strip club
10. In short if you believe Mohammed has confess to ever known crime on the face of the planet in the last hundred years, you need to cancel your subscription to the National Inquirer and the Rhino Times

Doug, the previous post claiming I did these things is a crude insult directed at me and they should be removed, especially the part about Anna Nicole Smith. Let me say that I did not have sex with that woman, Miss Smith, as it is well known of my preference for virgins and let's be honest, I hardly think Miss Smith would qualify. This was also a problem during my college years at A&T if it must be known was the main reason I de-matriculated, along with the insult of not being allowed to participate in the other great passion of my life as indicated above-step dancing.
Thank you.

Doug, the previous post claiming I did these things is a crude insult directed at me and they should be removed,*Khalid Sheikh Mohammed,
Ah stop whinning you cheap discount camel goat Herder. You are nothing but a Karl Rove outing everything that has occured on the planet in the last 2000 years. Dunk him again Cheney!
Khalid Sheikh Mohammed, after a tortuous residence in Gitmo, has told a secret military tribunal that he was responsible for 9/11 and just about every terror attack before and since. However, some parts of the transcript were blacked out.
My own Friend Jack Mayer has discovered that Mohammed also: "1) disposed of the body of Jimmy Hoffa, 2) was the second (of three) gunmen in Dealey Plaza, 3) was responsible for the breakup of The Beatles, 4) kidnapped the Lindbergh baby, and 5) drove one of the tanks that firebombed the Branch Davidian complex."
6. Cause Dook to lose last night!

I doubt families of 9/11 victims or Daniel Pearl's family think of KSM as some kind of joke.

What makes you think 9/11 victims think Mohammed did it? The 9/11 victim movement is much bigger than the mainstream media can even think of in their wildest control mind. You are aware of WT-7 building amazing structional failure aren't you Doug?
As to Pearl! Any family would grieve when a love one is murder in cold blood. That includes the bad guys families too.

Getting back on topic, to compare a military tribunal/trial with a civilian criminal procedure is apples-to-oranges.
Each deals with different acts, they are conducted by different rules and policies, and they each have different goals.
Don't confuse the two, or assume that one easily transitions into the other.
Allow the process to run it's course, it's worked for decades in past wars.
Posted on March 16, 2007 1:11 PM
But what do you think about the Pearl murder? Why not start out by trying KSM for that in a civilian court, win a conviction and the appropriate sentence? That seems the likely easiest, fastest way to make sure he never walks free again (if he's guilty, of course). Then proceed to the 9/11 case.
Posted on March 16, 2007 1:20 PM
You make a good point, Jaycee. But I almost think treating Khalid Sheik Mohammad as an enemy combatant in a military tribunal somehow legitimizes him. He's not a military leader or a soldier - he's a murdering criminal and nothing more.
I think he would get a fair trial in an American civilian court, and if he is as guilty as it appears, I have little doubt he would be punished appropriately.
Besides, bringing him to justice in an open, civilian court would be a powerful message about the power of democracy.
Just look at the Saddam Hussein trial. While people can criticize the war in Iraq , I thought the way his trial and punishment were handled was a positive signal to the Middle East. He received a fair trial (something that never happened under Hussein's own brutal regime) and paid the price for his crimes.
Posted on March 16, 2007 2:13 PM
If KSM confessed to these things why can they not just proceed to sentencing, or will his lawyers claim he confessed under duress?
Posted on March 16, 2007 2:30 PM
Apparently he hasn't had a lawyer to this point.
Posted on March 16, 2007 2:34 PM
Doug, there are different rules of evidence and procedure in military tribunals versus civilian criminal courts. I rather doubt the Pearl murder had the benefit of a full-blown, US style crime scene investigation, forensic evidence, etc. To hold a murder trial in a US court just might not be possible operating under the procedures necessary for a civilian criminal proceeding.
Though I don't know for sure, it's possible the tribunal considers the killing of Pearl to be the act of an enemy on the battlefield against US personnel rather than a murder as we recognize under US criminal codes. It could be the murder of Pearl is considered just another substantive act in furtherance of KSM's conduct as an enemy of the US.
KSM's future could be interesting, but I don't think it will be a long one.

Don't you know that the losers in a war never get a fair trial anywhere. Name us one loser who won a apples-to-oranges trial in ancient and modern history? Just one that's all?
Pop quiz for the apples and oranges trials.
1. Was Jefferson Davis found guilty at his trial and by what court?
