Ending illegal entry
The case of a former Alamance library worker underscores the complexity of illegal immigration and the need to revise immigration policy.
Marxavi Angel Martinez used to assist patrons at the Graham Public Library in Alamance County. Now she sits behind bars facing immigration charges.
Martinez, 23, was brought to this country from Mexico when she was 3 by her parents, who overstayed their visa. Martinez’s husband also has been arrested on immigration charges.
Martinez faces federal charges, including identity theft for using a dead man’s Social Security number. Her case, complicated even more by her 1-year-old, is worthy of a modern-day Solomon, and we’ll let the immigration judge decide it. But her situation shows why U.S. immigration policy needs revising.
Cases like Angel Martinez’s are the result of policy that is contradictory and ineffective. For many years, the nation haphazardly combatted illegal immigration, thus encouraging illegal immigrants and their employment. At the same time, it restricted access to legal immigration channels.
But things seem to be changing.
By defeating an immigration reform bill in Congress last year, opponents sent the message that more enforcement was needed before they would consider reform. The message seems to have been heard. Stepped-up enforcement against illegal aliens and their employers has caused the U.S. illegal immigrant population to drop by 11 percent in the past year, according to a new report by the Center for Immigration Studies. While a slowing economy has been a factor, the center reports that the decline began before the economic downturn.
Tough enforcement might seem heartless, but it is a necessary step toward ending the still-pervasive notion that it’s OK to enter this country illegally. It isn’t. It doesn’t benefit any of us to have millions of people living here whose first act in the country was to break one of its laws.
The lax attitude also isn’t good for the lawbreakers. Illegal aliens exist in a shadow world of limited opportunity that can lead to them being taken advantage of.
Only when strong enforcement has established that illegal entry won’t be tolerated can the United States increase immigration quotas. Only then can Congress consider such measures as the DREAM Act, which would allow those brought here illegally as children the chance to apply for citizenship if they live in the United States several years, finish high school and show “good moral character.”
The United States prides itself on being a nation of immigrants, not a nation of lawbreakers. Strict enforcement of immigration laws, plus a policy that provides more people the opportunity to legally enter this country, will help the nation hold on to this tradition.

This comes from the NR, that says we should give in state tuition, to these criminals? Round them up, send them home! Nothing is heartless about defending our country!

We don't own these uninvited aliens anything. If anything they own us for all the taxpayer funded programs used by their children. They know they are breaking the law and what could happen if they are caught. So tell me again why we owe them? Someone trespasses and when they're caught you open your house? What I don't understand is why is there any decision about it at all, It's crazy they are here illegal end of story, We don't need to change the law to suit illegals and the businesses that exploits them.

She has committed a serious crime aganist the Country,she should be deported as all law breakers should,no matter how sweet they seem to be.Praise for Sherriff Johnson in doing his job.My daughter is also a honnor student,but if she breaks the law she will have to go to jail.She knew what she was doing,I think it is grose to use a dead mans ss,plus using our welfare system,It's about time Alamance County does the right thing and send the illegas home.

A luke-warm editorial.....first it seems to reluctantly conclude that we must have immigration enforcement, then it finishes with the liberal (left liberals and right liberals), that we must increase our legal immigraiton inflows.
Why? Says who? The business elite who want a continued stream of cheap labor? The media elite? The political elites who are paid off by business to allow mass immigration (legal and illegal) to occur in the first place?
The DREAM Act is a joke. There must be punishment for illegal entry, identity theft, social security fraud, income tax evasion, driving without a license/insurance. These are the common crimes that most, repeat, most illegal aliens commit. DREAM Act is nothing but a liberal amnesty program.
The real problem is the chronically corrupt goverment of Mexico and it's desire to send 20-40 million MORE of it's peasants to the USA. The American people have spoken. We want immigration enforcement and we want a reduction in legal immigration. Any questions, elite?

I agree with the others in this post that this editorial contradicts itself by proposing tough law enforcement in one breath, and in the next it proposes that we implement the DREAM act.
It is proposals such as the DREAM act that continue to entice people to come here illegally. It has been documented that every time our government even hints at an amnesty or legalization program illegal immigration skyrockets.
So we need a comprehensive enforcement approach. One which includes enforcement at the workplace (that means jail time for employers), deportations of those arrested working illegally, jail time for identity thieves, denial of all public assistance to those here illegally and a stop to our nonsensical and stupid misrepresentation of our constitution which gives the children of illegals American citizenship. As long as we keep putting up goodies for those breaking the law, they will keep coming. Amnesties don't work - Enforcement does and when we enforce the law, people self deport -- It's that simple.

Deportation is really the only solution. Illegal aliens are trespassers and they are illegal, black market workers for sleazy businesses.
There are probably near 20 million illegals in our country. When will this end? When we are all speaking Spanish and kneeling on a muslim prayer rug, because the majority of immigrants - legal and illegal are either Spanish speaking (illegal) and Mohammedan followers (legal).
We're a "nation of immigrants"? Every nation is a "nation of immigrants" since no one grew out of the ground, the only difference is how far back people moved into a region. We're a nation of laws and it's high time, illegal immigrants, mostly Latino live by the same rules American citizens are required to live by.

Using a social security number that is not your own, whether it is made up, borrowed, bought, or stolen, is a federal felony for the purpose of protecting the integrity of our social security system. US citizens would face harsh penalties for commiting a felony; illegal aliens should not be held above the law. I agree with the editorial's opinion that given the government's deplorable record of enforcement, we cannot trust them to enforce the laws against illegal immigration and employment.
Please contact your representatives and senators and ask them to make E-verify employment verification mandatory for every single employer. It works! More will leave on their own if they cannot find employment.

The DREAM Act? No way! Why should we give illegals something that is denied some American students? How can we justify giving cheap in-state tuition to illegals all the while telling American citizens that live out of state that they have to pay more than an illegal? How can we justify telling foreign students who apply to college through proper channels and abide by our laws that they have to pay more than illegals?
You want more people coming here legally? What? We don't have enough traffic on the roads? I thought we're all supposed to be living "green" these days and reducing our carbon footprint. How will increasing the population help with this? We only have a finite amount of fresh water, arable land and buildable land.

I think without a doubt you gotta send her back, along with her 1 year old. If we get rid of these criminals and theyre offspring we can make this country a better place! The population of illegal mexicans are taking over this country without firing a shot! Lets stand up and do something about it with stricter laws, and follow through with them.

JRG: a quick note about the 1 year old. Because the child was born in the US, that child is a US citizen.
I agree with the general consensus that while this case is sad for Angela Martinez and her family, she is a scofflaw and deserving of no breaks by our courts. She knew she was doing the wrong thing by using someone else's SSN.
Either her child can stay with any family that is here legally, or the child can go with the mother to Mexico. But the child is a US Citizen, and it should be clear that the child can return at any time (probably at adulthood, but earlier if she becomes emancipated). And I don't have a problem with that part, because that is our law, and while some children get citizenship through the back door this way, it is less of a problem than that of the illegals overall.
But mom can't use that as a shield to stay in the US. The kid can go home to Mexico and come back later.
